DEFAULT
Indefinite contract

The CDI (contrat à durée indéterminée) is the default and legally preferred contract type in Morocco, ending only via resignation, mutual agreement, retirement, or lawful dismissal.

REGULATED USE

CDDs may only be used under Article 16 for replacing an absent employee, temporary business-activity increases, or seasonal work. In non-agricultural activities, cumulative CDD duration cannot exceed 1 year before automatic reclassification as CDI. Agricultural CDDs may be renewed annually up to 6 years before conversion.

WORKING HOURS
44-48 hrs/week

Standard workweek is 44 hours, daily max 10 hours. Agricultural work is annualized at 2,496 hours/year. Overtime capped at 250 hours/year, paid at +25% (day) to +100% (night on rest day/holiday).

PROBATION PERIOD
15 days-3 months

Under Article 14, probation is tiered by category: 15 days for day/hourly workers, 1.5 months monthly-paid employees, 3 months executives — each renewable once. CDD probation is capped at 2 weeks (contract ≤6 months) or 1 month (longer).

13TH / 14TH SALARY
Not Required

Morocco's Labour Code does not require a statutory 13th/14th month salary. A mandatory seniority bonus (prime d'ancienneté, Art. 350) provides 5%/10%/15%/20%/25% of base salary at 2/5/12/20/25 years of service. Discretionary year-end or Eid bonuses are common but not universal.

Statutory Benefits

In addition to statutory leave, employees are entitled to the following statutory benefits:

EMPLOYER CONTRIBUTIONS

Morocco's mandatory social security is administered by CNSS with health coverage via AMO. A MAD 6,000 ceiling applies only to the social-benefits contribution line.

  • Family allocations: 6.40% employer / 0% employee, no ceiling
  • Short/long-term social benefits: 8.98% employer / 4.48% employee, capped at MAD 6,000/month
  • AMO health insurance: 4.11% employer / 2.26% employee, no ceiling
  • Professional training tax: 1.60% employer only

Total: ≈21.09% employer / ≈6.74% employee.

WORKPLACE INJURY PROTECTION

Occupational accident/disease coverage (Law 18-12, 2014) is provided through mandatory private insurance (AT/MP policy), not CNSS.

  • Premiums borne entirely by the employer, set by insurer risk classification, roughly 1%-4%+ of payroll depending on sector risk.
SEVERANCE PAY

Statutory severance (indemnité de licenciement) applies to CDI employees with 6+ months of service dismissed other than for serious misconduct.

  • Years 1-5: 96 hours of wages/year of service
  • Years 6-10: 144 hours/year
  • Years 11-15: 192 hours/year
  • Years 16+: 240 hours/year

Courts may award damages up to 1.5 months' salary/year of service (capped at 36 months) for wrongful dismissal, on top of statutory severance.

13TH SALARY

Morocco has no general legal requirement for a 13th/14th month salary.

A dismissal is wrongful/abusive if it lacks valid legal ground or the mandatory procedure (written notice of alleged fault, hearing within 8 days, reasoned dismissal letter, labor inspectorate notification) was not followed. Courts may award damages up to 1.5 months' salary/year of service (capped at 36 months).
Objective / fair dismissal
Article 48 lists enumerated serious-misconduct grounds (theft, assault, breach of trust, unjustified absence 4+ days, drunkenness). Economic/structural redundancies affecting significant numbers at 10+ employee companies require prior consultation and, in some cases, provincial governor authorization.
During probation
No notice, cause, or severance required (probation 15 days to 3 months).
After probation
Once probation ends, the full statutory termination regime applies: valid ground, applicable notice, and statutory severance if 6+ months' CDI service and not gross misconduct.

How employees in Morocco get paid

Your employee's hours, time off, holidays, bonuses, and commissions are automatically calculated into payroll. RemoFirst will invoice you in either US Dollars (USD), Euros (EUR), British Pounds (GBP), Canadian Dollars (CAD), Australian Dollars (AUD), or Singapore Dollars (SGD) around the 15th of each month to make sure your employees are paid on time. To make it even easier, you can summarize your entire global team's salaries to aggregate them into one payment (instead of many individual payments).

Full-time Employees vs Global Contractors

Unlike full-time employees, contractors work on projects with multiple companies at a given time and are technically self-employed. Full-time employees are solely focused on their employer and usually receive benefits (such as health insurance, equity or stock options, and time off) as an additional form of compensation. While it can be cheaper to work with international contractors instead of paying benefits to a full-time employee, you run the risk of misclassification. It's recommended to work with an EOR for contractor onboarding and payments, so you can know that your international contractors are paid compliantly and on time.
